Alabama is known for its stringent gambling regulations, which distinguish it from neighboring states like Louisiana and Florida. There are only a limited number of casinos operating within Alabama, and none of them are authorized to offer table games. That is why many players turn to offshore casinos as an alternative.

Here is an overview of the options for gambling in Alabama.

  • Online Casinos: Offshore only
  • Online Sportsbooks: Offshore only
  • Poker: Not Available
  • Lottery: Not Available
  • Land-based Casinos: Tribal Casinos
  • Land-based sportsbooks: Not Available
  • Horse Racing: Available
  • Gambling Age: 18 years old

Alabama is one of the few remaining states that have resisted the widespread adoption of legalized gambling. The fact that Alabama is one of only five states that doesn’t have a lottery is evidence of its conservative stance. The state has also been slow to develop casinos. Tribal leaders tried to establish Class III facilities several times, but they have been blocked by numerous legal challenges and complications. These obstacles may contribute to the reluctance of lawmakers in Alabama to push for the legalization of casinos.

The most recent development in Alabama’s gambling landscape was a bill introduced to combine casino gambling, sports gambling, and a lottery into one comprehensive gambling act that was supposed to take effect by 2022. However, the bill failed to progress and remains in a state of uncertainty on the State House floor.

Should it be revived, it has the potential to bring about significant changes to the gambling scene in Alabama, but the fact that it didn’t gain traction the first time is discouraging. Ultimately, the current outlook is uncertain, despite neighboring states in the Southeast United States embracing legal gambling in full swing.

Land-Based Gambling in Alabama

As per Alabama Law Code 13A, the definition of gambling is outlined as follows:

A person engages in gambling if he stakes or risks something of value upon the outcome of a contest of chance or a future contingent event not under his control or influence, upon an agreement or understanding that he or someone else will receive something of value in the event of a certain outcome.

Alabama’s strict stance towards gambling has left little room for exceptions within its laws. Over the years, only a few limited exceptions have been made.

The following sections will provide you with an understanding of the types of gambling activities that are either permitted or prohibited within the state.

Tribal Casinos in Alabama

There is a common misconception that Alabama lacks any casinos. While this was true for a period, the scenario changed in 1988 with the passing of the Indian Gaming Regulatory Act by the Supreme Court. This legislation paved the way for several Native American gambling establishments to commence operations within the state.

Alabama’s tribal casinos are limited to Class II gaming, such as electronic bingo machines. These Class II machines may look similar to slots, but the odds and game mechanics are more related to bingo. The state has refused to negotiate on tribal gaming compacts that would allow Class III gaming, such as slot machines and table games.

Moreover, their availability is not widespread, considering the significant size of Alabama. There are only three tribal casinos and one racino in the state, so the options for players are quite restricted. Additionally, it’s important to note that there are no table games available for play in Alabama.

Here are the casinos available:

Horse Racing in Alabama

In the state of Alabama, residents have the legal option to engage in horse race betting, which is one of the few permitted forms of gambling. However, participation in horse race betting requires visiting an off-track wagering facility, as there is no horse racing conducted within the state.

These off-track facilities provide the opportunity to place wagers on races taking place outside Alabama, including races from other states and countries.

Alabama Gambling Timeline

2023
July

The 2023 legislative session has closed without any advancement toward new gambling legislation in Alabama. However, Advance Local reports that Rep. Andy Whitt and nine other lawmakers are working on a new bill that could be introduced during the 2024 legislative session.

2022
March

The state legislature introduced a bill proposing the authorization of six casinos, sports betting, and the establishment of a state lottery. Unfortunately, the bill did not get passed by the Alabama House of Representatives.

2020
January

Representative Steve Clouse introduced a lottery and casino expansion bill that would have allowed Alabama residents to vote on a state lottery in the November 2020 election. The House of Representatives never voted on it because of the Coronavirus pandemic, but legislators did launch a study group to explore the economic effects of gambling legislation.

2003
November

An amendment to the state’s constitution permits the operation of class III electronic bingo machines at VictoryLand casino in Alabama. However, the casino has experienced multiple openings and closures throughout the past decade due to ongoing legal disputes.

1988
October

The passage of the Indian Gaming Regulatory Act facilitated the establishment of three tribal casinos, currently situated in Alabama. This federal law effectively opened the doors for these tribal casinos to operate within the state, but Alabama has refused to negotiate on Class III Gaming.

1987
March

In an effort to diversify its offerings, Birmingham Race Course introduced horse racing alongside dog racing. However, the introduction of Thoroughbred horse racing failed to gain significant traction within the state, leading to the discontinuation of Alabama’s pursuit of the horse racing industry.

1980
September

In a historic development, charitable gambling was authorized for the first time through an amendment to the state constitution. This form of gambling is permitted on a county-by-county approval basis, with Jefferson County being the first to grant permission for charitable bingo.

1971
August

The legalization of pari-mutuel racing in the state introduced significant changes, particularly in relation to dog racing. At the time, there were no horse tracks in the state, so pari-mutuel racing primarily applied to dog racing.

1901
November

Similar to numerous states during that era, Alabama takes a strong stance against gambling by enacting a law that declares all forms of gambling to be illegal.

Future of Gambling in Alabama

The state of Alabama is currently experiencing a state of uncertainty regarding gambling. Legislators have promised at least one bill that could legalize a state lottery and other forms of gambling. However, lawmakers, lobbyists, and tribal leaders have pushed for similar laws several times in the past two decades. None of them have ever been passed. Representatives claim the new bill will be different because it will focus on what is best for Alabama’s residents, instead of the gaming industry, but that remains to be seen.

The establishment of Vegas-style casinos with a wide array of games might still be a considerable journey for Alabama. Even if the new gambling bill overcomes its hurdles and receives approval, it would only be presented to voters in late 2024 at the earliest. Moreover, if it is passed, there will still be a significant period of time required to address procedural matters and ensure smooth implementation.

Gambling Responsibly

According to the Alabama Council on Compulsive Gambling, it is estimated that around 2.2% of Alabama residents suffer from a gambling problem, with 6% at risk of developing one. However, the state government has taken measures to address this issue.

Responsible gambling can be harder than it looks, but there are resources such as helplines and support groups for individuals struggling with addiction.
