All sorts of gambling is legal in New Hampshire. The New Hampshire State Lottery holds sway over all licensure of gambling operations in the Granite State. Not that gambling is rampant here; according to the state’s Lottery Commission, there are only ten commercial bingo halls.

There are no tribal casinos, either (there are no federally-recognized Native American tribes in New Hampshire with which to compact). But there are sportsbooks, poker rooms are permitted, and pari-mutuel horse racing is allowed.

While there are “casinos” in New Hampshire, these are not Vegas- or Atlantic City-level operations. These casinos usually offer some combination of the following: slot machines (based on pull-tabs), table games, bingo, poker rooms, and sportsbooks.

New Hampshire has followed the rest of the nation in its view of lotteries. For a while, they were legal, then—during the great Louisiana Lottery Scandal of 1890—New Hampshire joined other states in banning lotteries forever.

Forever lasted until 1963, when the state again legalized lotteries. Today, the New Hampshire Lottery Commission regulates, licenses, and administers all forms of gambling operated within the state, from the lottery itself to parimutuel horse racing, sportsbooks, poker rooms, and bingo halls.

In 2017, New Hampshire began selling its lottery tickets on its official online website.

Sportsbooks have been legal in New Hampshire since 2019 (including mobile wagering within the state’s physical boundaries). The state currently licenses a single operator—DraftKings—which operates three sportsbooks in the state.

Does that mean New Hampshire hasn’t outlawed online gambling? While it would seem so, the state is one of those that takes the “all which is not explicitly permitted is illegal.” And since no law in the state’s Revised Statutes specifically permits online casinos, cautious gamblers must assume it is, in fact, outlawed.

The good news is New Hampshire has only enforced the law when it has found someone operating a gambling enterprise within the state; to date, there is no record of the state arresting or prosecuting anyone who placed a bet with any gambling operation. Obviously, New Hampshirites concerned about this state of affairs should consult a local gambling attorney for advice.

Horse Racing

There was a time not long ago (2008) when horseracing in New Hampshire accounted for two-thirds of the state’s gaming revenue.
